Terms of Service
These terms apply when you order a memorial film and card from In Memoriam Film. We have tried to write them plainly. Nothing here takes away the rights you have as a consumer under the law of the country where you live.
1. Who you are dealing with
In Memoriam Film is operated by SoundCam Productions Kft., 2364 Ócsa, Üllői utca 48., Hungary; company registration number 13-09-211186 (Budapest Környéki Törvényszék Cégbírósága); VAT number 13580100-2-13. Contact: support@inmemoriamfilm.com.
2. What you get
- A memorial film made from your photos and clips, in the length you choose (3, 5, 8 or 10 minutes), delivered as 1080p MP4 files in each format you ordered: with music and narration, music only, narration only (if you chose narration) and without sound; plus a loop version for the wake, with music and without sound.
- A memorial card with a photo, name, years, a short life story written only from your answers, and a QR code to the film, as a print-ready PDF and an image.
- A list of suggested funeral songs for the service. These are suggestions only: we do not supply those recordings.
- Optional narration of the life story by a calm narrator voice (never a copy of anyone's real voice).
Before the final version, you see a preview and can ask for changes. The order page shows what is included and the price before you pay.
3. Ordering and payment
Prices are shown before checkout and include any VAT or sales tax we must charge. Payment is taken by Stripe when you place the order. The contract is made when we confirm your order by email. You must be 18 or over to order.
4. Cancelling: your right of withdrawal
If you live in the EU or the UK, you normally have 14 days to cancel an online order. For digital content such as a film, that right ends once we start making it if you ask us to start straight away and confirm that you understand you will lose the right to cancel. Because families usually need the film within days, we ask you at checkout:
Please start making my film straight away. I understand that once you start, I lose my right to cancel and get a refund.
We confirm this in the order email. Because we start work straight away, the checkout needs this request; if you would rather keep your 14-day right, write to us before ordering and we will arrange a later start. This does not affect our promise in section 8: if we cannot make a film you are happy with, you get your money back.
5. Your photos and what you confirm
You keep all rights in the photos, clips and words you give us. You allow us to use them only to make, deliver and support your order, for as long as our Privacy Policy says we keep them. We never use them to train AI models. Before ordering, you confirm:
- I own these photos and videos, or I have permission to use them.
- The people shown agree to this, or I am acting for the family of the person who has died.
- I understand the film is AI-animated: moving photos are created by AI and are not real footage.
- I will not remove the AI labels from the film or the card.
- The photos do not show celebrities, and there are no intimate or explicit images.
- I am 18 or older.
We may refuse or stop an order that breaks these points — for example photos of public figures, intimate images, or content meant to mislead — and refund you.
6. AI-made content and labels
Some of the movement in the film, and photo restoration, is made by artificial intelligence. Moving photos are not real footage, and details can differ from how the person really looked. The film carries a visible AI label and embedded provenance information (Content Credentials), as EU law requires for AI-generated or manipulated images of real people. You agree not to remove these labels and not to present the film as real footage. More: AI disclosure.
7. Music in the film
The film’s soundtrack is instrumental music generated for your film. You may use the film with that music for private viewing, showing at the funeral, wake or memorial, live-streams of the service, and non-commercial posts on social media. You may not sell the film or the music, or register the music with a content identification system. If a platform flags the music by mistake, contact us and we will help.
If you add a commercial song yourself, its use is between you and the rights holders. See music rules at funerals.
8. If you are not happy
- You can ask for changes after the preview — reordering, removing photos, fixing names and dates, changing the mood of the music — with up to two rounds of changes included.
- If we still cannot make a film you are happy with, tell us before you download the final version and we will refund you in full.
- Your legal rights are not affected: digital content must match its description and be fit for purpose (in the EU, Directive (EU) 2019/770; in the UK, the Consumer Rights Act 2015). If it is not, we will fix it or refund you.
9. Delivery and availability
We deliver by a private download link sent by email. Links stay available for 12 months; please keep your own copy. We aim to deliver quickly, but if a delay would make the film miss the service date you gave us, we will tell you as soon as we know and you can cancel for a full refund.
10. Our responsibility
We are responsible for losses that are a foreseeable result of us breaking these terms or not using reasonable care. We are not responsible for losses we could not foresee, for how a venue's equipment plays the file, or for business losses. Nothing in these terms limits liability that cannot legally be limited, such as for death or personal injury caused by negligence, or for fraud.
11. Complaints and disputes
Please write to support@inmemoriamfilm.com first; we answer within 5 working days and try to resolve complaints within 30 days.
EU consumers may also turn to the conciliation body for our registered seat: Pest Vármegyei Békéltető Testület, 1055 Budapest, Balassi Bálint utca 25. IV/2., pmbekelteto@pmkik.hu (panaszrendezes.hu), or to the consumer authority or courts where they live. UK consumers may use the courts of England and Wales, Scotland or Northern Ireland.
These terms are governed by Hungarian law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you can bring a claim in your local courts.
12. Changes to these terms
The terms that apply to your order are the ones shown when you placed it. We keep a record of the version you accepted.
